Welcome to Giftopedia. These terms are an agreement between you and Giftopedia, a business operated in the United States ("Giftopedia", "we", "us"), governing your use of giftopedia.app and related services (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

Using the Service

• You must be at least 13 years old. If you are under the age of majority where you live, you need a parent or guardian's permission.
• Provide accurate information and keep your account credentials confidential. You are responsible for activity on your account.
• Use the Service lawfully and in good faith. Do not misuse it, interfere with it, attempt to access it or other users' accounts without authorization, or use automated means to access it without our permission.
• Do not use the Service to harass others, send spam, or share content that is unlawful, infringing, deceptive or harmful.

Your content

You keep ownership of the lists, items, notes, images and other content you submit ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce and process Your Content as needed to operate, secure and improve the Service and to show it to the people you choose to share it with. You confirm that you have the rights to Your Content and that it does not violate anyone else's rights or the law.

Lists marked public, and links you share, may be viewed by others. You are responsible for what you choose to share, including contact details of other people you invite. We may remove content or restrict access if we believe it violates these terms or the law.

Products, prices and third-party sites

Giftopedia helps you save and share gift ideas that link to third-party retailers. We do not sell the products. Product names, images, prices and availability come from you or third parties and may be inaccurate or out of date. Purchases are made on the retailer's site under its terms, and we are not responsible for those sites, products, orders, delivery or returns.

Some links are affiliate links. As an Amazon Associate and eBay partner, we may earn from qualifying purchases at no extra cost to you.

Reminders and messages

Reminders, invitations and notifications are provided as a convenience and may be delayed or not delivered. Do not rely on them for time-critical matters. You are responsible for having permission to give us any phone number or email you enter. Text-message terms are described in our Privacy Policy.

Our property

The Service, including its design, software, branding and content we create, is owned by Giftopedia and its licensors and protected by law. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes. You may not copy, scrape, resell, reverse engineer or create derivative works of the Service except as the law allows. Retailer names, logos and product images belong to their owners.

If you believe content on the Service infringes your copyright, contact us at the address below with details so we can review it.

Feedback

If you send us suggestions, you allow us to use them without obligation to you.

Suspension and termination

You may stop using the Service and delete your account at any time from your settings. We may suspend or end your access if you violate these terms, create risk or legal exposure for us or others, or if we discontinue the Service. Sections that by their nature should survive termination will do so.

Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free or secure, or that information on it is accurate or complete.

Limitation of liability

To the maximum extent permitted by law, Giftopedia will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US$100. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You agree to indemnify us against claims, losses and expenses (including reasonable legal fees) arising from Your Content or your violation of these terms or the law, to the extent permitted by law.

Governing law and disputes

These terms are governed by the laws of the United States and the state in which Giftopedia operates, without regard to conflict-of-law rules. Any dispute will be brought in the courts located where Giftopedia operates, and you and we consent to that jurisdiction, except where your local law gives you the right to bring a claim elsewhere.

General

These terms and the Privacy Policy are the entire agreement between you and us about the Service. If part of these terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these terms; we may transfer ours in connection with a business change.

Changes to these terms

We may update these terms. We will post the new version with a new "Last updated" date and, for material changes, give additional notice such as by email or in the Service. Continuing to use the Service after changes take effect means you accept them.
